1Who we are
Mona is provided by Jian Seo, an individual based in Australia. In these terms, “we”, “us” and “our” mean Jian Seo as the provider of Mona. “You” means the person using Mona.
Mona’s online service runs on infrastructure from service providers who act on our behalf: a hosting provider, a database provider and an AI provider. They are described in the Privacy Policy.
These terms cover the Mona app for iPhone and the online services it uses. By using Mona you agree to them. If you don’t agree, please don’t use the app.
2Apple’s licence terms
You get Mona from Apple’s App Store, so Apple’s Licensed Application End User License Agreement also applies. These terms sit alongside it and add the parts that are specific to Mona. If the two disagree about something Mona-specific, these terms apply to that point.
Apple is not responsible for Mona or for supporting it. Questions and problems come to us.
3What Mona is
Mona helps you make talking-to-camera videos. You talk through an idea, Mona writes a script from what you said, and a teleprompter follows your voice while you film. Some features run on your phone. Others, such as writing and revising scripts and analysing takes, use our online service and the AI provider behind it. The Privacy Policy explains what is sent and why.
Mona has a free plan and paid plans. What each plan includes is shown in the app before you buy.
Mona isn’t meant for children. You need to be at least 13 to use it, or 16 if you live in the European Economic Area or the United Kingdom.
4Subscriptions and billing
- Apple sells and bills them. Mona’s paid plans, such as Creator and Pro, are auto-renewing subscriptions bought through your Apple Account. We never see your card or payment details.
- They renew automatically. Payment is charged to your Apple Account when you confirm the purchase. A subscription renews at the end of each period unless you cancel at least 24 hours before the period ends. The renewal is charged within the 24 hours before the period ends.
- Prices are shown in the app and on the App Store, in your local currency, before you buy. If a price changes, Apple tells you in advance and, where Apple’s rules require it, asks you to agree first.
- Free trials. If a plan comes with a free trial, it turns into a paid subscription when the trial ends unless you cancel at least 24 hours before. If you buy a subscription during a trial, any unused part of the trial ends.
- Cancelling. Open Settings on your iPhone, tap your name, then Subscriptions, then Mona. Cancelling stops the next renewal. You keep what you paid for until the end of the current period. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under Apple’s policies. You can ask at reportaproblem.apple.com. We can’t issue App Store refunds ourselves. Nothing here limits your rights under the Australian Consumer Law (see section 12).
- Restoring. If you reinstall Mona or switch iPhones, use Restore purchases in the app to pick your subscription back up on the same Apple Account.
5Credits and fair use
Mona’s online features cost real money to run, so they draw on an allowance of credits. Each plan, including the free plan, comes with an allowance. If you run out, the app tells you when your allowance refreshes.
- Credits aren’t money. They have no cash value and can’t be sold, transferred or swapped for anything else.
- Different actions can use different numbers of credits.
- To keep Mona working for everyone, we may slow down or pause requests that look automated, abusive, or far beyond what one person could use. If that happens to you by mistake, email us and we’ll sort it out.
6AI can be wrong
Mona uses AI to write, revise and give feedback. AI makes mistakes. It can get facts, names, numbers and quotes wrong. It can misunderstand what you meant. It can sometimes produce text that resembles something already published.
- You’re in charge of what you publish. Read every script before you film it, and check any fact, claim or figure before you post.
- Feedback is coaching, not a forecast. Mona’s readings of your takes are estimates to help you practise. They don’t predict views, reach, retention or income.
- It isn’t professional advice. Nothing Mona writes is legal, medical, financial or other professional advice.
7Your content
Your rambles, scripts, recordings and everything else you make with Mona belong to you. We don’t claim ownership of any of it.
To run the features you use, you let us process your content: for example, sending what you said to our AI provider so it can write your script, and sending the result back to your phone. That permission is only for providing Mona to you. It ends when the processing is done, except for the limited records described in the Privacy Policy.
You’re responsible for your content and for how you use it. That includes making sure anything you publish is accurate, doesn’t infringe anyone else’s rights, and follows the rules of the platform you post it on.
8Videos and material you bring in
Mona lets you bring in other videos, for example a reference video you want to learn from. Only bring in material you have the right to use. Use what you import to study and practise, not to copy someone else’s work and pass it off as yours.
9Using Mona fairly
Please don’t use Mona to:
- break the law, or help anyone else break it;
- harass, threaten, defame or exploit anyone, or make content that sexualises children;
- impersonate a real person, or make content designed to mislead people about who is speaking or what is true;
- infringe someone’s copyright, trademark, privacy or other rights;
- get around credits, limits, or the way the app checks purchases;
- access our online service other than through the app, scrape it, overload it, probe it for weaknesses, or resell access to it;
- copy, modify or reverse-engineer the app, except where the law allows it.
Our AI provider has its own usage rules, and Mona may decline some requests because of them. When it does, the app tells you.
10Availability and changes
We work to keep Mona running, but online features need an internet connection and can sometimes be slow or unavailable. We may change, add or remove features over time. If we remove something you’re paying for in a way that matters, we’ll tell you in the app first, and your rights under the Australian Consumer Law still apply.
The scripts and takes in your library are stored on your phone, so they stay with you even if an online feature is down. Keep your own backups of anything important.
11Ending things
You can stop using Mona at any time. Cancel your subscription through Apple (see section 4) and delete the app.
We may suspend or stop your access to Mona’s online features if you seriously or repeatedly break these terms, if we have to by law, or if your use puts other people or the service at risk. Where it’s reasonable, we’ll explain why first and give you a chance to fix it. If we end your access without a good reason under these terms, we’ll help you get a refund of the unused part from Apple, or pay it to you directly.
12Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can’t be excluded. If you live outside Australia, the consumer protection laws of your country may give you rights too, and these terms don’t take them away.
13Limits on our liability
This section only applies as far as the law allows, and never to the guarantees described in section 12.
- Apart from those guarantees, Mona is provided as it is. We don’t promise it will be error-free or uninterrupted, or that what it writes will be accurate or suitable for your purpose.
- Where the law lets us limit our liability for failing to meet a consumer guarantee, and the service is not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to supplying the service again or paying the cost of having it supplied again.
- We aren’t liable for loss of profits, revenue, audience or opportunity, or for indirect or consequential loss, arising from your use of Mona or from content you publish.
- Otherwise, our total liability to you for anything connected with Mona is limited to the amount you paid for Mona in the 12 months before the claim arose.
- Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited by law.
14Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes go to the courts of New South Wales and the federal courts of Australia. If you are a consumer living elsewhere, you can also rely on the mandatory laws and courts of the place you live.
If something goes wrong, please email us first. Most problems are quicker to fix than to argue about.
15Changes to these terms
We may update these terms as Mona changes. We’ll post the new version here with a new effective date. If a change matters to you, we’ll also tell you in the app before it takes effect. If you keep using Mona after that, the new terms apply. If you don’t agree, you can cancel and stop using Mona.
If any part of these terms turns out to be unenforceable, the rest still applies.
